2. Description of Service

BuyMeFlower is a universal tipping platform that enables fans to support creators and enables creators to receive tips. Our Service includes:

• Creator profile creation and management
• Social media handle search and discovery
• Secure tip processing and payment handling
• Creator wallet and balance management
• Payout processing to creators
• Tip history and analytics
• Support for multiple payment methods (Stripe, Apple Pay, Google Pay, etc.)
• Global payment support including regional payment providers

Our Service provides a tipping platform. We facilitate payments between fans and creators, but we are not responsible for creator content or disputes between users.

3. Tipping and Payments

IMPORTANT: Tips sent through our Service are processed securely through third-party payment processors. All tips are final and non-refundable unless required by law or in cases of fraud.

When you send a tip:

• You authorize the payment for the tip amount
• The tip is processed immediately and credited to the creator's wallet
• Tips are subject to a 10% platform fee (90% goes to the creator)
• All tips are final transactions
• You are responsible for ensuring you have sufficient funds

Creators receive tips in their wallet and can withdraw funds according to our payout policies. Payouts may be subject to processing times and fees depending on the withdrawal method.

4. Limitations of Service

You acknowledge and agree that:

• Creator Content: We are not responsible for the content created by creators on our platform. Creators are solely responsible for their content and any claims related to it.
• No Guarantees: Our Service provides a tipping platform only. We do not guarantee that creators will produce content or that tips will result in any specific outcomes.
• Compliance: You are responsible for ensuring that your use of our Service complies with applicable laws in your jurisdiction, including tax obligations.
• Technical Limitations: While we strive for 99.9% uptime, our Service may experience downtime, interruptions, or technical issues.
• User Responsibility: You are responsible for ensuring that tips are sent voluntarily and that you have the right to send tips.
• Third-Party Services: Our Service may integrate with third-party services. We are not responsible for the availability or functionality of third-party services.

5. Limitation of Liability

• Your use or inability to use our Service
• Any tips you send or receive through our Service
• Any errors, omissions, or disputes related to tips or payments
• Any legal consequences, disputes, or losses arising from tips or creator content
• Any unauthorized access to or use of our servers or your data
• Any interruption or cessation of transmission to or from our Service
• Any bugs, viruses, or other harmful code that may be transmitted through our Service
• Any failure of payment processing or payout delays

OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING FROM OR RELATED TO THE USE OF OUR SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE TWELVE (12) MONTHS PRIOR TO THE CLAIM, OR $100, WHICHEVER IS GREATER.

Some jurisdictions do not allow the exclusion or limitation of liability for consequential or incidental damages, so the above limitation may not apply to you.

You agree to indemnify, defend, and hold harmless BuyMeFlower, its officers, directors, employees, contractors, and agents from and against any and all claims, damages, obligations, losses, liabilities, costs, or debt, and expenses (including attorney's fees) arising from:

• Your use of our Service
• Any tips you send or receive through our Service
• Your violation of these Terms
• Your violation of any third-party rights
• Any legal consequences, disputes, or losses arising from tips or creator content
• Any claims related to creator content or disputes between fans and creators

7. User Accounts and Responsibilities

7.1 Account Creation

To use our Service, you must create an account. You agree to:

• Provide accurate, current, and complete information
• Maintain and update your information to keep it accurate
• Maintain the security of your account credentials
• Accept responsibility for all activities under your account
• Notify us immediately of any unauthorized access
• Ensure that you have the authority to sign documents on behalf of yourself or your organization

7.2 Prohibited Uses

You agree not to:

• Use our Service for any illegal purpose or in violation of any laws
• Sign documents on behalf of others without proper authorization
• Impersonate any person or entity or misrepresent your identity
• Interfere with or disrupt our Service or servers
• Attempt to gain unauthorized access to our Service or other accounts
• Use automated systems (bots, scrapers) to access our Service without permission
• Reverse engineer, decompile, or disassemble our Service
• Resell or redistribute our Service without authorization
• Upload malicious code, viruses, or harmful content

9. Subscription and Payment

9.1 Subscription Plans

We offer various subscription plans with different features and usage limits. Our Free plan allows basic e-signature functionality, while Pro plans ($29/month) include advanced features such as bulk sending, custom branding, certificate upload, and API access. Enterprise plans are available for larger organizations.

9.2 Payment Terms

• You agree to pay all fees associated with your subscription
• Fees are non-refundable except as required by law or as stated in our refund policy
• We may change our pricing with 30 days' notice
• If payment fails, we may suspend or terminate your account
• You are responsible for any taxes applicable to your use of our Service

9.3 Cancellation

You may cancel your subscription at any time. Cancellation takes effect at the end of your current billing period. You will continue to have access to the Service until the end of your paid period. After cancellation, you may continue to access signed documents but may lose access to certain features.

10. Intellectual Property

10.1 Our Content

All content, features, and functionality of our Service, including but not limited to text, graphics, logos, software, and technology, are owned by BuyMeFlower or its licensors and are protected by copyright, trademark, and other intellectual property laws.

10.2 Your Documents

You retain ownership of documents you upload and sign through our Service. However, by using our Service, you grant us a license to:

• Store and process your documents to provide the Service
• Generate electronic signatures and audit trails
• Comply with legal obligations

We do not claim ownership of your documents, and we will not use your documents for purposes other than providing and improving our Service.

11. Document Storage and Security

We provide secure storage for documents you upload and sign through our Service. However:

• You are responsible for maintaining backups of important documents
• We may delete documents after a period of inactivity or account closure, as specified in our data retention policy
• We implement industry-standard security measures, but cannot guarantee absolute security
• You are responsible for ensuring that documents you upload do not contain sensitive information that should not be stored in our system
• We may access your documents only as necessary to provide the Service, respond to support requests, or comply with legal obligations

You retain ownership of all documents you upload. We do not claim ownership of your documents, and we will not use your documents for purposes other than providing and improving our Service.

12. Termination

We may terminate or suspend your account and access to our Service immediately, without prior notice, for any reason, including:
